A. General

In this privacy policy, we inform you about how we collect and process personal data when you visit our website, contact us, have a business relationship with us as a supplier or service provider, or use one of our services. B. Data controller and contact details

MediClub takes the protection of personal data very seriously. Personal data is any information relating to an identified or identifiable natural person. This includes, for example, name, address, telephone/fax number and email address.

We comply with the data protection legislation applicable in Switzerland.

C. Place of data processing

We only process your personal data in Switzerland.

D. Collection of general information when visiting our website

During a visit to our website, only data that is usually recorded is collected, such as your IP address, date and time, which pages were accessed, the amount of data transferred, the website from which it was accessed, and the identification data of the browser used. The data collected is used exclusively for the purpose of obtaining general statistical data on the use of the website. We do not publish this data or pass it on to third parties without authorisation.

We may use cookies and similar technologies on our website to identify your browser or device. A cookie is a small file that is sent to your computer or automatically stored on your computer or mobile device by the web browser you are using when you visit our website. When you visit our website again, we can recognise you, even if we do not know who you are. Google Analytics uses cookies. The information generated by cookies about your use of this website is usually transferred to a Google server in the USA and stored there. G. Use of our social media pages

On our social media pages, you will find posts on current news and our range of services. Social media providers collect and analyse usage data such as the number of visits and demographic information about visitors to our company pages.

We receive evaluations created by social media providers based on this data. These only contain aggregated or otherwise sufficiently anonymised data. Only the respective provider can identify you based on the usage data collected. Therefore, please note the data protection information of the respective provider.

H. Newsletter and contact form

You can subscribe to our newsletter to receive information about news and other information about MediClub and MediClub partners by email. You can also contact us via the contact form or by email. We store and process the data you provide exclusively for the purpose of sending the newsletter or responding to your enquiry and to the extent necessary. You can unsubscribe from the newsletter at any time (opt-out). In this case, the data stored for the purpose of receiving the newsletter will be deleted.

I. Information to customers

Customer data: When you contact us as a customer, MediClub processes general personal data, e.g. your name and contact details, as well as any information about your position or role in the organisation on behalf of which you are contacting us. We also process data that is necessary for the execution of any contracts between the customer/member and MediClub. You provide us with this data; we collect some of it ourselves (e.g. from public registers or websites) or it is transmitted to us by third parties.

J. Information for applicants

When you apply for a job with us, we process the data you provide, such as your contact details, qualifications and other information in your CV. We process your data until the application process is complete. We may forward your data to external third parties (e.g. for assessments) or contact third parties (e.g. to obtain references) as part of the application process.

K. Information to suppliers/partners

Supplier and partner data: If you contact us as an employee of a supplier or partner, MediClub processes general data relating to the supplier or partner or the responsible contact person, e.g. name and email address, as well as any information about your position or role in the organisation on behalf of which you are contacting us. We also process data that is necessary for the execution of any contracts between suppliers/partners and MediClub.

L. Disclosure of personal data to third parties

If necessary or beneficial for registration, sending the newsletter, responding to your enquiry or processing a contract, including invoicing and debt collection, we may pass on your data to a company affiliated with MediClub or an external service provider (e.g. certification bodies, debt collection agencies). These are obliged to process the data exclusively on our behalf and in accordance with our instructions and must comply with the applicable legal provisions.

M. Data security

We use technical and organisational security measures to adequately protect your personal data against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. To this end, we use state-of-the-art encryption methods. We continuously improve the security measures we have in place in line with technological developments. Nevertheless, internet-based data transmissions can always have security gaps, meaning that absolute protection cannot be guaranteed.

N. Purpose-specific data processing

We will only store your data for as long as is necessary to fulfil the respective purpose for which you have provided us with your data or to comply with legal obligations (e.g. retention regulations).

O. Your rights

You may request confirmation or information about the processing of your personal data at any time. You also have the right to request the correction, supplementation, deletion or restriction of the processing of your personal data, as well as the transfer of your personal data in a structured, commonly used and machine-readable format. Furthermore, you have the right to withdraw your consent to data processing at any time. You also have the right to lodge a complaint with the competent data protection supervisory authority.

Please note that legal requirements and exceptions apply to these rights. Consequently, we may refuse your request to exercise these rights if, for example, it would violate legal obligations such as retention requirements. Your request may also be refused based on the assertion, exercise or defence of legal claims.

We are not liable for any damage caused by the use or non-use of the information provided on our website or using incorrect or incomplete information on our website.

Our website contains links to third-party websites. We have no knowledge of their exact content and cannot influence it. We accept no liability for the content of external links.

Q. Copyright

Texts and graphics on our website are protected by copyright. Use by third parties is only permitted with the express consent of MediClub.

R. Validity of the privacy policy and terms of use

We may unilaterally change or update the privacy policy and terms of use at any time.

S. Payment processing (credit cards/subscriptions)

We use the payment service provider Worldline SA, Saferpay, Hardturmstrasse 201, 8005 Zurich, Switzerland, to process online payments (one-off payments and subscriptions).

When you make a payment via our platform, the data required for payment processing (e.g. name, amount, currency, transaction information) is transmitted directly to Worldline. MediClub does not store or process complete credit card details at any time. Payment processing is carried out exclusively via Worldline's systems.

Worldline is solely responsible for processing payment data and complies with the applicable security standards, in particular the PCI DSS standard. Further information on data processing by Worldline can be found in their privacy policy:

No payment data is collected for the use of free areas of the platform.

T. Free and paid services

MediClub provides a platform with free and paid functions and areas. The scope of the free services can be adjusted or restricted at any time.

Paid services are clearly marked as such and require successful payment.

There is no entitlement to the permanent availability of free services.

U. Subscriptions, billing and cancellation

Paid services can be purchased as part of a subscription. Unless otherwise stated, subscriptions are billed periodically in advance and are automatically renewed for another year.

Subscriptions can be cancelled at any time via the self-service functions within the platform at the end of the current billing period.

If cancellation via the platform is not technically possible, it may be done by email in exceptional cases, using info@mediclub.ch. In this case, the cancellation shall also take effect at the end of the current billing period.

Subscription or usage fees that have already been paid will not be refunded unless mandatory legal provisions stipulate otherwise.

V. Payment processing

Payment processing is carried out by external payment service providers, in particular Worldline Saferpay. MediClub does not store or process complete credit card details and does not act as a payment service provider.

MediClub is not liable for payment disruptions that are beyond its control.
